Regulation of the activity and rules

Comercial Godó, S.L., has activities regulated under the RD 1254/99 SEVESO of serious accidents which implies among other regulations and issues:

1. Have a self-protection plan updated biannually that consists of, among other things: own brigades of fast intervention, at least one in-house firefighter and a plan of continuous safety training.

2. Perform a Qualitative Analysis of Risks updated every 5 years automatically or, in case of changes, whenever it is required for its own activity. This analysis is carried out by external engineering consultants that evaluate the possible risks in our facilities, such as their impact on our surroundings and neighbors. International auditors validate this analysis. Once validated, the training and security measures taken from the analysis are collected.

3. Have a Security Management System containing the followingº:

• Description of working methods: work permits, change management, continuous training, establish work procedures, control of atmospheric emissions, acoustics, water tributary effects, maintenance control of the company…

• This system is audited once a year by the competent authority (Generalitat de Catalunya), through an external certifying entity that drafts a security opinion, which proposes improvements of obligatory compliance.

• Environmental authorization inspected by entities external to Comercial Godó.

4. At the product level all the substances commercialized by Comercial Godó are documented according to the current regulations of classification (CLP 1272/2008) and REACH (Regulation of the European Union 1907/2006) on registration, evaluation, authorization and restriction of substances and chemical mixtures. Its main objective is to improve the protection of human health and the environment against the risk that may be involved in the manufacture, marketing and use of chemicals and their mixtures.

5. Have two internal security counselors that guarantee that the ADR loading, unloading and transportation is done correctly.

The Center for Intelligence against Terrorism and Organized Crime (CITCO) of the Ministry of Interior regulates, controls and establishes obligations in the placing of precursor substances of explosives, drugs and chemical weapons into the market.

EXPLOSIVE PRECURSORS:

  • Regulation (EU) No 98/2013 of the European Parliament and of the Council of 15 January 2013 on the marketing and use of explosive precursors (consolidated version).
  • Law 8/2017, November 8, on explosive precursors.
  • Resolution, November 20, 2013, of the Secretary of State of Security which appoints the Center for Intelligence against Terrorism and Organized Crime as the National Contact Point for the communication of suspicious transactions, thefts and disappearances of explosive precursors.
  • Resolution, May 16, 2018, of the Secretary of State of Security, which establishes the models of the application and the license that authorizes individuals to acquire, own, use or introduce into Spain the restricted explosive precursors foreseen in Law 8/2017, November 8, on explosive precursors.
  • The permanent instability in which we live, despite the restrictions and controls that were established in Regulation 98/2013, the European Commission has approved a new Regulation (EU) 2019/1148 in order to extend these restrictions and controls by limiting the access to them.
  • Explosive precursors are substances, such as hydrogen peroxide (oxygenated water), acetone or sulfuric acid among others, which are used by consumers as well as industries. It is of great importance that all companies throughout the supply chain, including the trade sector, must know their obligations in relation to these products to prevent them from being used in the illicit manufacturing of explosives

The Center for Intelligence against Terrorism and Organized Crime (CITCO) of the Ministry of Interior regulates, controls and establishes obligations in the placing of precursor substances of explosives, drugs and chemical weapons into the market.

DRUG PRECURSORS:

  • Law 4/2009, June 15, on the control of drug precursors.
  • Royal Decree 129/2017, February 24, approving the Regulation of Control of Drug Precursors.
  • Regulation (EC) 273/2004, February 11, of the European Parliament and Council on drug precursors (consolidated version).
  • Council Regulation (EC) 111/2005, December 22, establishing rules for the surveillance of drug precursor trade between the Union and other countries (consolidated version).
  • Delegated Regulation (EU) 2015/1011, April 24, 2015, by the Commission which completes the Regulation (EC) No.273 / 2004 of the European Parliament and of the Council on drug precursors and Council Regulation (EC) No 111/2005 which establishes rules for the surveillance of the trade in drug precursors between the Union and other countries and repeals Commission Regulation (EC) No 1277/2005 (consolidated version).
  • Economic operators and end users have certain obligations in relation to drugs with chemical precursors; regulations in effect in this field, process for registration and licensing with their respective instructions for completion.
